“THE LIST” $100.00 DISTRICT GIFT CARD MONTHLY DRAWING
OFFICIAL CONTEST RULES

1.  ELIGIBILITY RESTRICTIONS: The District at Green Valley Ranch The List $100.00 District Gift Card Monthly Drawing (the Promotion) is open to any Nevada resident 18 years of age or older except employees of the Sponsor, its parent company, its parent companys subsidiaries, any affiliated advertising/marketing agencies, and participating sponsors/promotional partners, and the members of the immediate families or individuals domiciled with representatives of any of the above. 

 2.  SPONSOR: The Promotion is sponsored by American Nevada Company, a Nevada limited liability company (Sponsor).

 3.  AGREEMENT TO OFFICIAL RULES: Participation in the Promotion constitutes entrants full and unconditional agreement to and acceptance of these Official Rules and the decisions of Sponsor, which are final and binding. Winning a Monthly Prize (defined below) is conditioned upon the selected entrants fulfilling all requirements set forth herein in a timely manner.  Failure to comply with the contest rules may result in disqualification.

 4.  ENTRY PERIOD: The Promotion begins on January 1, 2010 at 12:01 a.m. Pacific Standard Time (PST) and ends on December 31, 2010 at 11:59 p.m. PST (the Entry Period).   

 5.  HOW TO ENTER AND PARTICIPATE IN THE PROMOTION: To enter the Promotion, log on to www.TheDistrictatGVR.com, follow the link on the home page entitled Get On The List $100 District Gift Card, and complete and submit the online entry form found at such link.  The Promotion may also be entered by sending a 3x5 card including the entrants name, mailing address, email address, and telephone number to American Nevada Company, 901 North Green Valley Parkway, Suite 200, Henderson, Nevada 89074, Attention: Marketing Department.  Only one entry per person, per household will be accepted. Duplicate entries will be disqualified. 

6.  MARKETING DATABASE AND PRIVACY STATEMENT.  Entry into the Promotion by submitting an online entry form will add the entrant to the marketing database that is maintained by Sponsor for purposes of distributing promotional material related to The District at Green Valley Ranch (the Marketing Database).  By participating in the Promotion, the entrant consents to receive, through email, direct U.S. Mail, and/or other forms of media, promotional and marketing materials related to The District at Green Valley Ranch.  Every email distributed to members of the Marketing Database will include an opt out link, where, if clicked, entrant can request to be removed from the Marketing Database.  Opting out of the Marketing Database removes entrant from the Promotion.  Each entrants privacy is very important to Sponsor.  Personally identifiable information about each entrant may be used to improve Sponsors marketing and promotional efforts with respect to The District at Green Valley Ranch.  Sponsor will not sell or rent any personally identifiable information about the entrants of the Promotion to any third party.  Sponsor may give your personal information to the tenants of The District at Green Valley Ranch for their marketing and promotional purposes.  This policy only addresses the use and disclosure of information we may collect from you. To the extent that an entrant discloses personally identifiable information to third parties, different rules may apply to their use or disclosure of personal information the entrant discloses to them. 

7.  DRAWING:  On the first business day of each calendar month during the Entry Period, Sponsor will select from all individuals who have properly entered the Promotion as described in paragraph 5 above one (1) name (the Winner) in a random drawing for the Monthly Prize (each, a Drawing).  Sponsors decisions are final with respect to the results of the Drawing.  An entry must be received by Sponsor no later than 11:59pm on the last day of a calendar month during the Entry Period to be eligible for the drawing that will be held for the calendar month during which the entry is received.  An entrant need only enter the Promotion one time to be eligible for all monthly Drawings. The Winner need not be present to win.  The Winner will be notified by telephone and/or e-mail.  Sponsor will attempt to notify the potential winner within seven (7) days of each Drawing.  If, after fourteen (14) days of reasonable and unsuccessful efforts by Sponsor, notification of the potential winner is unsuccessful, such winner shall be disqualified and Sponsor will select an alternate potential winner in his/her place at random from all remaining eligible entries.  Sponsor shall repeat the notification process mentioned in this paragraph with respect the alternate potential winner.  The above notification and alternative selection process shall be repeated until a winner is successfully contacted.
 
8. PRIZES: One gift card valued at One Hundred Dollars ($100) that is redeemable at most stores located at The District at Green Valley Ranch (the Monthly Prize) will be awarded at each monthly Drawing.  The Monthly Prize must be picked up by the Winner between the hours of 8:00 a.m. and 5:00 p.m. PST, Monday through Friday, at the offices of Sponsor located at 901 North Green Valley Parkway, Suite 200, Henderson, Nevada 89074.  Each Monthly Prize must be claimed no later than 5:00 p.m. PST on the last business day of the calendar month that the winner has been notified or such Monthly Prize will be deemed forfeited by the Winner. The person identified as the Winner must claim the Monthly Prize in person.  Monthly Prizes are not transferable and non-refundable and must be accepted as awarded, and may not be substituted with any other item except by Sponsor, who reserves the right to substitute another prize of comparable or greater value.  An entrant may only win one (1) Monthly Prize during the Promotion.  Should a previous Winner be selected as the Winner of a subsequent Drawing, such Winner will be automatically disqualified and another entrant will be randomly selected for such Drawing.  The odds of winning depend on the total number of entries received.
 
9.  REQUIREMENTS OF THE POTENTIAL WINNER; RELEASE: Each Winner will be required to complete and return an affidavit of eligibility and liability/publicity release (the Affidavit/Release) within seven (7) days of being notified by Sponsor. If the potential winner fails to sign and return the Affidavit/Release within the required time period, Sponsor will select an alternate potential winner in his/her place at random from all entries received.  By receipt of a prize, winner agrees to release and hold harmless Sponsor, its affiliates, its corporate licensee, and each such persons officers, directors, employees, shareholders, shareholder or member entities, and agents (the Released Parties) from and against any claims, costs, expenses, liabilities, damages or causes of action arising out of such entrants participation in the Promotion or receipt or use of any Monthly Prize.  

 10.  PUBLICITY: Participation in the Promotion constitutes each Winners consent to Sponsors use of such Winners name, likeness, voice, opinions, biographical information and affiliations for promotional purposes in any media, worldwide, without further payment or consideration or rights to royalties for such use.  Winners may be required to sign a promotion release form with respect to such publicity prior to receiving a Monthly Prize.

11.  LIMITATIONS OF LIABILITY: The Released Parties are not responsible for: (a) any inaccurate information, whether caused by entrants or printing errors; (b) unauthorized human intervention in any part of the Promotion; (c) technical failures of any kind; (d) technical or human error which may occur in the administration of the Promotion or the processing of entries; or (e) any injury or damage to persons or property including, but not limited to, death, which may be caused, directly or indirectly, in whole or in part, from entrants participation in the Promotion or receipt or use of any Monthly Prize. If for any reason an entrants entry is confirmed to have been erroneously deleted, lost or otherwise destroyed or corrupted, entrants sole remedy is another entry in the Promotion.  SPONSOR SHALL NOT BE HELD LIABLE TO ANY ENTRANT ON ACCOUNT OF OR DUE TO BREACH OF THESE OFFICIAL RULES IN OR FOR AN AMOUNT THAT EXCEEDS ONE MONTHLY PRIZE AND SPONSOR SHALL NOT BE LIABLE TO ANY ENTRANT (NOR TO ANY PERSON CLAIMING ANY RIGHT, TITLE OR INTEREST DERIVED FROM OR AS SUCCESSOR TO ANY ENTRANTS RIGHT, TITLE AND INTEREST) FOR INCIDENTAL, INDIRECT, CONSEQUENTIAL OR SPECIAL DAMAGES OF ANY KIND INCLUDING, WITHOUT LIMITATION, LOST REVENUES OR PROFITS, LOSS OF BUSINESS OR LOSS OF CONTENT ARISING OUT OF THIS PROMOTION, IRRESPECTIVE OF WHETHER THE SPONSOR HAS ADVANCE NOTICE OF THE POSSIBILITY OF SUCH DAMAGES.

12.  Disputes: Each entrant agrees that: (a) any and all disputes, claims and causes of action arising out of, or connected with, the Promotion or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in the State of Nevada; (b) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred by the entrant associated with entering the Promotion, but in no event attorneys fees; and (c) he/she waives the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages.  All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, entrants rights and obligations, or the rights and obligations of the Sponsor in connection with the Promotion, shall be governed by, and construed in accordance with, the laws of the State of Nevada, without regard for the effect to any choice of law or conflict of law rules which would cause the application of the laws of any jurisdiction other than the State of Nevada.

13.  DISCLAIMER OF WARRANTIES. SPONSOR DISCLAIMS ANY AND ALL WARRANTIES, CONDITIONS OR REPRESENTATIONS, WHETHER OR NOT IMPLIED, ORAL OR WRITTEN, WITH RESPECT TO, RELATED TO, OR ARISING FROM THE PROMOTION OR ANY TRANSACTION REASONABLY CONTEMPLATED BY THE SPONSOR OR ANY PERSON THAT MAKES AN ASSENT PURSUANT TO THE PROMOTION INCLUDING, WITHOUT LIMITATION, ANY AND ALL IMPLIED WARRANTIES OR CONDITIONS OF TITLE, NON INFRINGEMENT, MERCHANTABILITY, FITNESS OR SUITABILITY FOR ANY PURPOSE (WHETHER OR NOT THE SPONSOR KNOWS, HAS REASON TO KNOW, HAS BEEN ADVISED OR IS OTHERWISE, IN FACT, AWARE OF ANY SUCH PURPOSE), WHETHER ALLEGED TO ARISE BY LAW, BY REASON OF ENTRANT USAGE IN THE TRADE OR BY COURSE OF DEALING, INCLUDING, WITHOUT LIMITATION, RELEVANT SYSTEM MALFUNCTION OR FAILURE.

14.  OFFICIAL RULES AND WINNERS LIST: Promotion results and a copy of these Official Rules may be obtained by logging on to www.thedistrictatgvr.com or by sending a self-addressed, stamped envelope to American Nevada Company, 901 North Green Valley Parkway, Suite 200, Henderson, Nevada 89074-7105, attn: Legal Department.
 
15.  TAX INFORMATION:  All federal, state, local, and other taxes on Monthly Prizes are the sole responsibility of the Broker.  Winners agree to supply their name, social security number, address and phone number to American Nevada Company and may be required to sign an IRS Form 1099 or the equivalent. Winners are responsible for all service charges, if any, which may be associated with a Monthly Prize.

16.  GENERAL CONDITIONS: Sponsor reserves the right to cancel, suspend, and/or modify the Promotion if any fraud or other factor beyond Sponsors reasonable control hinders the administration of the Promotion, as determined by Sponsor in its sole discretion. Sponsor reserves the right in its sole discretion to disqualify any individual Sponsor determines, in its sole discretion, to be tampering with the operation of the Promotion, or to be acting in violation of these Official Rules or in an unsportsmanlike or disruptive manner. Any attempt by any person to undermine the legitimate operation of the Promotion may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsors failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.  Time is of the essence.  No prize will be awarded unless all terms and conditions of this Promotion have been satisfied.  Sponsor reserves the right to make changes in the rules of the Promotion, which will become effective upon announcement. Sponsor, its corporate licensee, affiliated companies, parent corporations and subsidiary companies of such corporations thereof, are not responsible for failure to conduct or for alterations to the contest due to circumstances beyond the control of any such entity.  No purchase necessary. The contest is void where prohibited.
